These Terms & Conditions (the "Terms") govern your access to and use of The InPlay Challenge 2026 (the "Challenge"), the inplaytradingchallenge.com website, and the InPlay mobile app (together, the "Service"), operated by InPlay Global, Inc., and its subsidiaries and affiliates (collectively "InPlay," "we," and "us").

By creating an account, entering the Challenge, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and any update or amendment to said terms and policy. If you do not agree, do not use the Service.

You must be at least 18 years old and a resident of the United States to create an account and participate. Identity and age are verified through our identity-verification provider.

One account per person. You are responsible for providing accurate information and for all activity under your account.

A valid, accessible email address is required to register and is the permanent anchor for your account, account recovery, identity verification, and important notices. You must verify your email before you can complete identity verification.

The Challenge is a free-to-enter, skill-based competition played with simulated funds ("InPlay dollars"). InPlay dollars have no cash value, cannot be withdrawn, exchanged, or transferred, and are used solely to take part in the Challenge.

Outcomes are earned through skill, knowledge, timing and consistency: you earn your position; nothing is won by chance. The Challenge is NOT betting, gambling, a sportsbook, a prediction market, fantasy sports, a sweepstakes, a securities offering, or a real-money market, and no real money is ever deposited, traded, or placed at risk.

Nothing in the Service is financial, investment, legal, or tax advice.

To help keep the Challenge fair and to meet our legal and compliance obligations, you must complete an identity check provided by our third-party verification vendor before your participation is confirmed and your referral code is issued.

Verification, including any biometric processing, is performed by Persona, our third-party identity-verification provider, acting as a service provider or processor on our behalf. We receive only the verification result and limited identifiers needed to confirm eligibility, link the verification to your account, prevent fraud, and meet applicable compliance requirements. When your account is verified you receive a referral code you can share. Referral rewards are paid in simulated InPlay dollars only and have no cash value. Referral codes are applied at sign-up only.

Self-referrals, fake or duplicate accounts, automated sign-ups, and any attempt to manipulate referral attribution are prohibited and may result in removal from the Challenge and forfeiture of simulated balances. Full referral mechanics are described in the Referral Program Terms.

Eligibility for and the award of any prizes are governed by the Competition Rules and Prize Pool Terms, which form part of these Terms. Prizes (where offered) are earned based on skill-based performance, subject to verification of eligibility and compliance with these Terms. No purchase is necessary to enter or to be eligible for prizes.

You agree not to: break the law; cheat, exploit, reverse-engineer or interfere with the Service; use bots, create multiple or fraudulent accounts; harass other users; attempt to gain unauthorized access; or otherwise use, or attempt to use, the Service in a manner which is prohibited or restricted, at our sole discretion. We may suspend or remove accounts that breach these Terms or the Acceptable Use Policy at our sole discretion, with or without notice.

The Service, including its software, design, trademarks, and content, is owned by InPlay, or a subsidiary or affiliate of InPlay, or its licensors and is protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for the sole purpose of participating in the Challenge. League or team names, league or team marks, and player likenesses referenced in the experience remain the property of their respective owners and do not imply any endorsement.

We may suspend or terminate your access if you breach these Terms or where required for legal, security, or compliance reasons.

When an account is closed or deleted, we use soft deletion: the account is deactivated and archived rather than permanently erased. We retain certain records, including identity-verification and anti-money-laundering (AML/KYC) records and an audit log of key account events, for as long as required by law. This means the legal right to erasure does not apply to records we are required to keep for AML/KYC purposes. See the Privacy Policy for details.

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. The Challenge is simulated and for competition and entertainment only.

To the maximum extent permitted by law, InPlay and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Service. By utilizing the Service, you expressly assume any and all liability related therewith. Because the Challenge uses simulated funds, you cannot lose real money through gameplay.

You agree to indemnify and hold InPlay and its subsidiaries and affiliates harmless from claims, losses, and expenses arising out of your misuse of the Service or breach of these Terms.

Prior to the commencement of the Challenge, new terms and conditions will be implemented; these terms and conditions are designed to govern the pre-Challenge registration period. After commencement of the Challenge, we may update these Terms from time to time. We will post the updated version here with a new effective date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where applicable law provides otherwise.
